Meredith Swisher is a partner at Bernkopf Goodman specializing in complex business and real estate litigation. She has represented financial institutions, landlords, tenants, individual property owners, developers and title insurance companies in a wide variety of real estate and commercial disputes in both state and federal courts. Her experience includes contract claims, resolution of title defects, title insurance litigation, permitting and zoning, and commercial and residential summary process eviction actions, including post-foreclosure eviction litigation.

Meredith also has extensive experience defending financial institutions, national banks, institutional lenders and other creditors from various lender liability claims, including M.G.L. c. 93A, private causes of action under the Home Affordable Modification Program (HAMP) and other modification programs, the Fair Debt Collection Practices Act, the Truth in Lending Act, the Predatory Home Loan Practices Act, and the Real Estate Settlement Procedures Act. Meredith is well versed in and counsels clients on recent case law, statutes and regulations affecting residential loan modifications, foreclosures, and post-foreclosure evictions, including the impact of such law on the prevention and resolution of both lender liability claims and quiet title litigation.

  • Obtained summary judgment in favor of property owner against municipality over public easement rights on property, which decision was upheld by the Massachusetts Appeals Court
  • Successfully defended title insurance company in connection with flood damage to a basement condominium unit that could not legally be rebuilt; title insurer’s denial of coverage was upheld by the Massachusetts Appeals Court
  • Successfully defended national bank against claims that interest rates charged by it violated the National Bank Act; dismissal of claims was upheld by the Massachusetts Appeals Court
  • Obtained summary judgment in favor of lender and property owner against claim by Bankruptcy Trustee seeking to void sale of debtor’s property and mortgage granted by new owner during the pendency of debtor’s bankruptcy without prior court approval
  • Obtained summary judgment in favor of lender in bankruptcy adversary proceeding claiming violations of RESPA and Federal Debt Collection Practices Act
  • Successfully defeated preliminary injunctions seeking to prevent foreclosure and defended lenders in a wide variety of lender liability claims
  • Successfully defended commercial landlord in summary process eviction proceedings, obtaining and successfully collecting $100,000 in unpaid rent
  • Tried case against national supermarket chain that resulted in jury verdict in favor of client
